বিষয়টি সম্পর্কে আইনজীবী ও আইন বিশেষজ্ঞ সিয়াক্রোনি, S.H., C.I.R.P., CPM., CPArb.

Third Legal Notice Issued by Lawyer Edi Kurniawan Tampubolon Amid Dispute Over Loan Repayment
INTERNATIONAL DESK | INDONESIA
A dispute over a personal loan has sparked controversy in Bekasi, Indonesia, after a borrower claimed to have repaid IDR 11 million against an original loan of just IDR 5 million. Despite the payments, the borrower has reportedly received a legal notice accusing him of fraud over the alleged outstanding debt.
According to an investigative report published by Indonesian media outlet Gensa Media Indonesia, a Bekasi resident identified as DI borrowed IDR 5 million from an individual identified as RN, also known as Mama Sela, in September 2025.
The borrower reportedly claimed that an agreement had initially been reached to repay IDR 6 million in total. However, he later allegedly faced demands to pay IDR 1 million every month.
DI claimed that he had been making regular monthly payments since September 2025 and had paid approximately IDR 11 million in total. However, according to the lender’s calculation, the payments were treated as interest, while the principal loan amount allegedly remained outstanding.
DI further alleged that after informing the lender about his financial difficulties, he was subjected to pressure through WhatsApp messages and phone calls. He also claimed that he had been verbally abused and threatened.
Third Legal Notice Issued
Acting on behalf of lender RN, also known as Mama Sela, the law office of Advocate and Legal Consultant Edi Kurniawan Tampubolon issued a third legal notice to the borrower.
The notice, dated October 30, 2026, reportedly referred to Article 492 of Indonesia’s Law No. 1 of 2023 concerning fraud-related offences and warned of possible legal proceedings. The notice also referred to penalties of up to four years’ imprisonment or a fine under the relevant legal provisions.
The notice further invited both parties to attend a meeting at 9:00 a.m. on November 2, 2026, to seek an amicable settlement. It stated that if the dispute could not be resolved through discussion, the matter could be referred to law enforcement authorities and pursued through the courts.
Lawyer’s Position
Regarding the matter, lawyer Edi Kurniawan Tampubolon reportedly stated that legal proceedings would be initiated if the concerned individual failed to attend the scheduled meeting.
In a subsequent message, he reportedly told journalists that they would meet in court and also indicated that further communication should cease.
Meanwhile, efforts to obtain comments from the lender, RN, also known as Mama Sela, were unsuccessful before publication.
Does Failure to Repay a Loan Automatically Constitute Fraud?
Commenting on the matter, lawyer and legal expert Siakroni, S.H., C.I.R.P., CPM., CPArb., stated that failure to repay a loan within the agreed period does not automatically establish a criminal offence of fraud.
According to him, it is essential to determine whether the borrower had an intention to commit fraud from the outset, or whether money was obtained through false information, deception, or fraudulent methods.
He explained that an inability to repay a loan due to financial difficulties may, in many circumstances, constitute a civil dispute or breach of contractual obligations rather than a criminal offence.
He also referred to Articles 1238 and 1243 of Indonesia’s Civil Code, which address contractual obligations and compensation for breach of contract.
Call for Transparent Accounting and an Impartial Investigation
According to the legal expert, if the borrower has indeed repaid approximately IDR 11 million against an original loan of IDR 5 million, a detailed examination of the principal amount, interest, instalments, and payments already made is essential.
The allegations raised by the borrower, the lender’s claims, and the contents of the legal notice should be examined impartially to establish the actual circumstances.
Both parties should be given an opportunity to present their positions, while relevant financial documents and payment records should be carefully reviewed to ensure that the dispute is resolved in accordance with the law.
